About

Daniel M. Cohen has been an attorney with Cuneo Gilbert & LaDuca, LLP and its predecessor firms (including the Cuneo Law Group PC) since 1999.  His practice at CGL focuses on representing plaintiffs in class action and complex litigation involving antitrust and consumer protection issues.  Mr. Cohen’s experience includes conducting extensive discovery, hearings, and arguments in both federal and state courts. His work at CGL has resulted in significant results for our clients including:

  • Secured a $34 million dollar settlement against U.S. Smokeless Tobacco after intense litigation in several state courts as a member of the lead attorney team. This indirect purchaser lawsuit alleged that U.S. Smokeless Tobacco monopolized the moist snuff market and engaged in restrictive and exclusionary acts in violation of state antitrust laws.
  • Secured a $16.2 million settlement against Visa and Mastercard while serving as a Special Assistant Attorney General for the State of West Virginia. The funds subsidized several sales tax holidays for West Virginia consumers.
  • Assisted the trial team in the landmark case O’Bannon v. NCAA No. 09-3329 (N.D Cal.2014) by deposing key N.C.A.A. executives and introducing a novel approach utilizing the “Freedom of Information Act” to procure lucrative contracts between individual state universities and private entities.
  • Successfully represented hundreds of individual life insurance policyholders who chose to participate in an alternative dispute resolution process when resolving their rights against Prudential Insurance Company.
  • Successfully argued the case of Arizona Bunker’s Glass Co. v. Pilkington PLC, 2006 Ariz. 9 (2003) before the Arizona Supreme Court. It allowed indirect purchasers to have standing to bring lawsuits in that state.

Prior to joining CGL, Mr. Cohen was an Assistant Public Defender for Florida’s Fourth Judicial Circuit serving Jacksonville, Duval County, Florida.  During this tenure Mr. Cohen represented hundreds of clients facing criminal charges including capital felony cases. He conducted over 70 jury trials as lead attorney.
