JENNIFER E. KELLY joined Cuneo Gilbert & LaDuca, LLP in 2011, where her law practice has focused primarily on representing plaintiffs in antitrust, consumer protection, and product liability class actions and complex litigation cases. Ms. Kelly has been a key member of teams that have achieved the following results:
- $400 million settlements for automobile dealers from auto parts manufacturers who engaged in international, unlawful coordination of their pricing and sales on certain auto parts. In Re: Automotive Parts Antitrust Litigation, Case No. 12-md-02311 (E.D. Mich.). In connection with this case, Ms. Kelly has finalized more than 65 settlements, helped to develop and implement complex plans of allocation for the settlement funds for each of the 40-plus parts affected by the litigation, and coordinated efforts to efficiently distribute settlement funds.
- $26.6 million clawed back for the State of Mississippi from participants in the “Mississippi Hustle” conspiracy that defrauded the Mississippi Department of Corrections of hundreds of millions of dollars in taxpayer funds by paying kickbacks to obtain contracts.
- Consumers class settlements against banks for unlawful mortgage foreclosures and overdraft fees.
- Settlements against manufacturers of building products, such as defective wood and window manufacturers, and dangerous piping.
Examples of Ms. Kelly’s current caseload include:
- Multiple cases brought by hospitals against opioid manufacturers and distributors for their role in creating the opioid epidemic in the United States, and the resulting harm to hospitals.
- Fifth Amendment Takings cases brought against the United States for harm to plaintiffs’ properties from flooding caused by the U.S. Army Corps of Engineers’ operation of the Old River Control Complex on the Mississippi River. Plaintiffs hold more than 350,000 acres of property along the Mississippi River near the ORCC, and include the State of Mississippi on behalf of school districts with adversely affected properties.
Prior to joining CGL, Ms. Kelly prosecuted and settled more than 100 cases of fraudulent use of National Red Cross trademarks as a volunteer attorney. While working at another Washington, D.C. law firm, Ms. Kelly handled antitrust issues, including regulatory filings, competition counseling, and investigating white collar crime and government contracting fraud.
While in law school, in addition to working full time as a paralegal, Ms. Kelly volunteered as a Student Attorney, arguing fraud cases before both the Maryland Court of Special Appeals and the Maryland District Court for Montgomery County. In the latter court she was successful at obtaining a judgment, on behalf of a Spanish-speaking client, in connection with a telemarketing fraud scheme.
Prior to attending law school, Ms. Kelly served as a Legislative Assistant for Senator Robert C. Byrd. In this position, she worked to reestablish West Virginia State College’s eligibility to receive its share of federal and state funds available for Historically Black Colleges and Universities. She also helped Senator Byrd pursue federal investigation into and recognition of Gulf War Syndrome.
Ms. Kelly was named a Super Lawyers Rising Star in 2015, 2016, and 2017 for the Washington, D.C. area.

Ms. Kelly also holds leadership roles within the legal community. As Vice-Chairperson of the Climate Change Committee for the Committee to Support the Antitrust Laws (COSAL), she co-authored Climate and Antitrust, a forthcoming paper in the Georgetown Environmental Law Review that explores the intersection of antitrust law and environmental protection.
Prior to joining CGL, Ms. Kelly served as a Legislative Assistant to Senator Robert C. Byrd, where she worked on policy initiatives such as reestablishing West Virginia State College’s eligibility for HBCU funding. She also prosecuted and settled over 100 cases of fraudulent use of National Red Cross trademarks as a volunteer attorney.
While in law school, Ms. Kelly worked full time as a paralegal and served as a Student Attorney, successfully arguing fraud cases in Maryland courts. She later gained experience handling antitrust regulatory filings, white-collar crime investigations, and competition counseling at a Washington, D.C., law firm.
Ms. Kelly has been recognized for her accomplishments with numerous awards, including being named a Super Lawyers Rising Star in 2015, 2016, and 2017. She is also listed as a Top 25 Class Action Trial Lawyer by National Trial Lawyers.
