MONICA MILLER focuses her practice primarily on representing plaintiffs in consumer protection, antitrust and securities cases. She has over twenty years’ experience litigating major securities and consumer class actions, as well as smaller securities actions involving small and mid-cap companies.
Her practice has consisted primarily of the representation of investors in both class action and non-class action securities fraud litigation, and in shareholder derivative litigation. She has also represented financial professionals in litigation arising from securities transactions.
In Pergament v. Roach, 41 A.D.3d 569 (2d Dept. 2007), Ms. Miller achieved the reversal by the appellate court of a grant of summary judgment for investment bankers in action brought on behalf of the estate of a biotech company alleging breach of fiduciary duty, and later settled the case.
In Touch Networks v. Gogi Design, 163 Wash. App. 1012 (2011), Ms. Miller obtained the reversal by the Washington Court of Appeals of a judgment (after bench trial) entered by the trial court, in action raising somewhat novel questions concerning the intersection of state contract law and federal copyright law, and obtained a favorable settlement. In Gassaway v. Jacobs (17th Cir. Ct. Broward Co., Fla. 2012), Ms. Miller defeated multiple motions for summary judgment, and obtained certification of a class of noteholders in an action against investment bankers who managed a private placement of securities in a small publicly held company, and obtained two separate settlements, the second on the eve of trial.
Mr. Cuneo and Ms. Miller recently represented documentary filmmaker Len Morris (director of Stolen Childhoods, an award winning documentary about child labor) in an ERISA action concerning eligibility for pension and health benefits with the pension and health plans associated with the Directors’ Guild of America. Morris v. Directors Guild of Americia – Producer Health Plan (D. Mass. 2014). The case raised questions of plan interpretation particularly relevant to directors engaged in nonprofit and public interest film making. The matter was resolved with a confidential settlement.
Mr. Cuneo and Ms. Miller also recently represented the trustee of the estate of famed humorist Arthur Buchwald in a dispute with Citibank, N.A., Buchwald v. Citibank, N.A. (D.D.C. 2014), in which the estate alleged that Citibank’s negligence permitted rogue financial advisor Kenneth Starr to embezzle funds from the estate through the establishment of an unauthorized line of credit. The matter was resolved with a confidential settlement.
Prior to joining CGL, Ms. Miller served as a law clerk to the Honorable Edith Brown Clement, U.S. District Judge for the Eastern District of Louisiana (1991-1993), and then practiced at a major class action firm in Boston (1994-1999), and as a solo practitioner (1999-2008), with her practice focused on shareholder litigation and other securities-related litigation.
