David L. Black is a trial attorney with more than 44 years of experience representing a diverse array of clients in products liability, commercial and intellectual property suits. Mr. Black has successfully represented American and foreign plaintiffs in complex litigation, including high-stakes class actions and multidistrict litigation, recovering millions of dollars in both settlements and judgments.
Mr. Black is a nationally recognized expert in the use of scientific evidence and the development of evidence for use at trial. He is one of only two practicing attorneys to have authored a subject matter manual in the third edition of the Reference Manual on Scientific Evidence.
Mr. Black is continuing his complex litigation and evidence development work at the firm as part of a team of attorneys representing hospitals across the country in litigation in areas of the country particularly hard hit by the ongoing opioids health crisis. His clients have brought actions against manufacturers and distributors of prescription opioids concerning the impact of their actions upon hospitals and the role of hospitals in abating the opioid crisis.
Mr. Black continues to represent plaintiffs in products liability actions, including owners of properties with defective plumbing systems. His past products liability results include:
- The highest jury verdicts in Colorado in 2002 and 2003 in trials against Goodyear involving defective Entran II hose;
- An over $300 million settlement of the Entran II hose class action litigation in 2004;
- A multimillion-dollar verdict for a homeowner in a 2005 Entran II jury trial;
- multimillion-dollar jury verdicts in agricultural chemical litigation for farmers against DuPont;
- millions of dollars of settlements of agricultural chemical litigation for farmers in Australia, Costa Rica and the United States;
- national class action settlements for manufacturers of polybutylene plumbing systems against multinational manufacturers of materials used in those systems;
- bi-national class settlements, achieved via litigation and agency actions, against a Fortune 5 company which used plastic venting in furnaces and boilers;
- multimillion-dollar settlements of claims against a Fortune 50 company involving industrial products containing nuclear materials;
- litigation on behalf of the state of Louisiana against German and Chinese government-affiliated entities involving defective Chinese-manufactured drywall.
Mr. Black heads the firm’s Colorado office and resides in and is admitted to practice in Colorado. He enjoys Martindale-Hubbell’s highest (AV) rating based on peer review.
Mr. Black’s community activities involve athletics, music and theatre for his four children, one stepchild and three grandchildren.
