BRENDAN S. THOMPSON focuses his practice primarily on representing plaintiffs in consumer and civil rights cases.
During his legal studies, Mr. Thompson worked as a Student Intern for Congressman Brian Higgins (NY); as a Student Law Clerk for the Honorable LeRoy F. Millette, Jr. at the Circuit Court for the 31st Judicial Circuit of Virginia; and as a Student Law Clerk at the Commonwealth’s Attorney’s Office for Prince William County, Virginia.
Since joining the firm, Mr. Thompson has litigated cases across the country and has served as counsel, and co-lead counsel, in some of the leading defective building materials class actions. In 2009, he received a diploma from the National Institute for Trial Advocacy (“NITA”).
Mr. Thompson has provided lunches to the homeless as a volunteer with Bethesda Cares, donated to Esperanca, participated in Washington Nationals Youth Baseball Academy functions, and assisted the Wood Acres Neighborhood with events and activities. He has also spent time mentoring first year students enrolled in the University of Baltimore School of Law’s 1L Mentor Program.

BRENDAN THOMPSON joined Cuneo Gilbert & LaDuca, LLP as a lawyer in 2008. Before 2008 he served as a paralegal and law clerk at the firm. Mr. Thompson’s practice focuses on false advertising, civil rights, and product liability cases.
Mr. Thompson’s litigation experience includes: conducting pre-trial and expert discovery (including offensive and defensive Daubert related work); organizing and supervising teams of lawyers and paraprofessionals with document database coding projects (including predictive coding); researching and drafting motions and briefs; preparing and making arguments before courts; mediating cases; participating in multidistrict litigation (“MDL“); preparing and planning for trial; and participating in appellate litigation. Mr. Thompson’s appellate work includes briefing before the Third and Ninth Circuits. See Wright v. Owens Corning, 679 F.3d 101, 109 (3d Cir. 2012), cert. denied, 133 S. Ct. 1239 (2013).
Successful cases Mr. Thompson has worked on while at the firm include:
- Melillo, et al. v. Building Products of Canada, 12-cv-16 (D. VE) (concerning alleged defective organic roof shingles) (nationwide settlement).
- Minor, et al. v. Congoleum(D. N.J.) (concerning alleged defective flooring products and refusals to honor warranties) (nationwide settlement).
- In re: Building Materials Corp. of America(D.S.C.) (concerning alleged defective fiberglass roof shingles) (nationwide settlement).
- In re Kitec Plumbing Systems(N.D. of Tex.) (concerning alleged defective PEX plumbing systems) (nationwide settlement of $125 million).
- In re: IKO Manufacturing(C.D. of Il.) (concerning alleged defective organic roof shingles) (nationwide settlement).
In December 2017, Mr. Thompson was appointed co-lead counsel by then Senior Judge Thelton Henderson of the United States District Court for the Northern District of California in Gold, et al. v. Lumber Liquidators. The case concerns Morning Star bamboo flooring which Plaintiffs allege prematurely fails (expands and contracts and cannot withstand normal relative humidity variations) when installed in homes. Plaintiffs successfully defended against motions to dismiss, Daubert motions, a motion for summary judgment, and a transfer of venue motion. The parties exchanged nearly one million pages of discovery and engaged in approximately twenty fact and expert depositions in the case. Plaintiffs certified six state classes and defeated a subsequent Rule 23(f) petition. The Court approved the Parties’ settlement on October 22, 2020. The settlement provides for a $14 million common cash fund and $16 million in vouchers to be paid by Lumber Liquidators. See Gold v. Lumber Liquidators, Inc., 323 F.R.D. 280 (N.D. Cal. 2017).
Complex consumer cases Mr. Thompson is currently working on are:
- Jones, et al. v. Charlotte Pipe and Foundry Company and Lubrizol Advanced Materials, Inc., 20-cv-00511 (N.D. Ohio) (concerning alleged defective chlorinated polyvinyl chloride (“CPVC”) pipe and fitting plumbing systems sold under the brand name FlowGuard Gold®).
- Klaehn, et al. v. Cali Bamboo, LLC, Case No. 3:19-cv-01498 (S.D. Cal.) (concerning alleged defective bamboo flooring systems).
- Hawes, et al. v. Macy’s Retails Holding, Inc. and Macy’s West Stores, Inc., No. 1:17-cv-00754 (S.D. Ohio) (concerning alleged false thread counts (as counted under industry standard ASTM 3775) in sheets and pillowcases).
