Kitec – Defective Plumbing Products

In re: Kitec Plumbing System Products Liability Litigation (MDL No. 2098).

UPDATE: On November 17, 2011 Judge Royal Furgeson, Senior Judge in the Northern District of Texas, granted final approval to a $125 million all cash settlement concerning defective Kitec Plumbing Systems.

Charles LaDuca, court appointed co-lead counsel, is proud to announce a settlement in Cuneo Gilbert & LaDuca's large multi-district litigation against the Ipex Company, a Toronto-based producer of the defective Kitec plumbing systems.

This case was settled for $125 million dollars and was granted Preliminary Approval on May 2, 2011.

The plaintiffs, a nation-wide class of home and business-owners who bought the defective Kitec plumbing system between 1997 and 2007, sought to recover damages for a new system and damages incurred from the defective piping. The plaintiffs charged that Ipex not only designed and manufactured a faulty product, but that they also marketed and sold it without disclosing the risks to consumers, and have failed to honor their product's warranty.

In search of cheaper materials, it was alleged that Ipex used defective brass fittings to connect lengths of pipe. The brass fittings are particularly prone to dezincification, which restricts water flow and causes the pipes to become pressurized. The pressurized pipes eventually leak, resulting in water damage that requires removal and/or replacement of the entire system. The lawsuit also alleged that IPEX refused to honor its purported 30-year warranty.

The plaintiff and the class are seeking a declaratory judgment that IPEX is liable for all costs of removing and replacing the Kitec plumbing system, as well as other related consequential damage that resulted from defective brass fittings that have failed.

Zurn – Defective Plumbing Products Litigation

In In re Zurn Pex Plumbing Products Liability Litigation, Civil Action No. 08-CV-1681 (D. MN), MDL No. 1958 (U.S. District Court for the District of Minnesota; Panel on Multidistrict Litigation) We filed a lawsuit against Zurn Pex, Inc. and Zurn Industries LLP on behalf of a proposed nationwide class of property owners with a defective Zurn Plumbing system with cross-linked Pex tubing and brass fittings. CertainTeed – Defective Shingles

In re CertainTeed Corp. Roofing Shingle Products Liability Litigation, Civil Action No. 2:06-04243, MDL, No. 1817 (U.S. District Court for the Eastern District of Pennsylvania)

Charles LaDuca was appointed co-lead counsel in a multi-district litigation (MDL) regarding defective CertainTeed organic shingles. The suit alleges that CertainTeed's organic shingles fail to perform as marketed and that CertainTeed knowingly and intentionally concealed these defects. The suits also allege that CertainTeed had no intention of providing the services set forth in their warranties for these roofing shingles.

IKO – Defective Shingles

In re IKO Roofing Shingle Products Liability Litigation, MDL No. 2104 (Central District of Illinois)

We have filed lawsuits against IKO Manufacturing Inc. alleging that they design, manufacture, advertise and sell various defective roofing shingle products.

Along with three other similar suits, plaintiffs allege that the shingles fail to perform as marketed and that IKO knowingly and intentionally concealed these defects. The suits also allege that IKO had no intention of honoring their warranties for these roofing shingles. Charles LaDuca was appointed chairman of the Steering Committee.

Uponor – Defective Plumbing Products

McGregor v. Uponor, Inc. Civil Action No. 09-CV-1136 (U.S. District Court for Minnesota)

We filed a lawsuit against Uponor, Inc. on behalf of a proposed class of property owners with the defective Uponor plumbing systems. We allege that Uponor's systems contain defective brass fittings and are subject to failure, causing severe damage to homes, offices and other buildings.

 

The brass fittings used to connect lengths of pipe are particularly prone to dezincification, which restricts water flow and causes the pipes to become pressurized, leading to burst pipes and significant water damage. The lawsuit alleges that Uponor, Inc. falsely claim that its products are safe, reliable, corrosion-resistant and virtually maintenance free. The lawsuit also alleges that Uponor made certain representations in their warranty that they do not honor.

The plaintiff and the class are seeking a declaratory judgment that Uponor is liable for all costs of removing and replacing its plumbing system, as well as other related consequential damage that resulted from defective brass fitting that have failed.
